Draft Schedule of Main Modifications to Section 2 Colchester Local Plan

Representation ID: 8213

Received: 11/11/2021

Respondent: Belinda Baker

Legally compliant? Yes

Sound? No

Duty to co-operate? No

Representation Summary:

There is no mention of use of UXDs on the site and mention of of BSE contamination The area already is distinctive and a buffer in the area with regards to other housing developments and proposed ones around it. The inclusion of Middlewick Ranges will just make this area an urban scrawl. There is a concern on fly-tipping but there is more around the area where the MTC is located and Friday Woods, this is not part of the deveopment area.

Change suggested by respondent:

The LP should include the spefics of contamination and that a risk assesments will be needed in respect of UXDs and BSE contamination not just desk top surveys.

Representation Summary:

There are 1000's of livestock, cattle and sheep carcasses that were buried on Middlewwick Ranges after Foot and Mouth outbreak in 2000/01 that could present a health risk if disturbed and will have caused major contamination to some areas of the land. This land should remain undisturbed.

Change suggested by respondent:

This should be mentioned as currently it is not. Also associated findings around the health risks of the diseased livestock.

Inadequate policies on contaminsation

Change suggested by respondent:

Based on this previous behaviour a clause needs to be added to ensure the MOD remains liable for future contamination issues for the next 30 years.

Full text:

The behaviour of the MOD in reporting contamination in the past has not been acceptable.
They continually stated for instance that no animal remains from the foot and mouth crisis were buried on the site. Even though this was witnessed by local residents. They even denied this in a direct question posed by Colchester MP Will Quince in Parliament and in Freedom of Information requests and despite archive news reports in local papers confirming this story at the time. However, we were able to eventually obtain the paperwork from Defra confirming that animal remains from foot and mouth were buried on the site. They have since confirmed remains are buried on site.
In a previous development on the former Cherry Tree Camp site dangerous gases were seeping up into some of the houses on that estate with residents having to be evacuated whist the situation was investigated. The MOD would not co-operate with the investigation and did not contribute to the investigation or correcting the issue.
